Terms & Conditions
Welcome to Anita’s Cake House. These Terms & Conditions apply to orders placed through our website and set out the terms on which we supply our cakes, desserts and other products.
By placing an order with us, you confirm that you have read and understood these Terms & Conditions.
1. About Us
Anita’s Cake House is a sole trader bakery business based in County Durham, United Kingdom.
For questions about an order, our products or these Terms & Conditions, please contact us using the contact details provided on our website.
2. Products
We make a range of cakes, desserts, cookies, cheesecakes, tray bakes, macarons and other sweet treats.
Product images are provided for illustration and presentation purposes. As our products are handmade, there may be small variations in colour, decoration, size or appearance.
Where a product is personalised or made to a customer's requirements, the final appearance may vary from reference images or inspiration photographs.
3. Product Availability
All products are subject to availability.
We reserve the right to limit quantities or decline an order where we are unable to fulfil it to the required standard.
If we are unable to fulfil an order after payment has been made, we will contact you and arrange an appropriate refund where applicable.
4. Ordering
Please check your order carefully before confirming it.
All orders must be placed in advance and are subject to availability and confirmation by Anita’s Cake House.
We recommend placing your order a few days before your preferred date to allow sufficient preparation time.
If you require an order for the following day, please contact us first. This may be possible depending on availability and must be agreed with us in advance. Next-day orders are not guaranteed.
You are responsible for ensuring that the information you provide is accurate, including your name, contact details, delivery area or postcode, preferred date and any personalised information.
An enquiry does not automatically create a confirmed order. Your order will only be confirmed once the products, price, date and delivery or collection arrangements have been agreed with us.
5. Prices & Payment
All prices displayed on our website are shown in GBP (£).
Available payment methods will be confirmed when your order is discussed or at checkout, where applicable.
For collection orders, cash payment may be available where agreed in advance.
Any additional delivery charges will be communicated and agreed with you before your order is confirmed.
We reserve the right to update product prices, but any price applicable to an order already accepted by us will not be changed after the order has been confirmed, except where permitted by law.
6. Custom Cakes
Custom cake orders are handled separately from standard online products.
A custom cake enquiry does not automatically create a confirmed order.
After receiving your enquiry, we may contact you to discuss your requirements, including the date, size, flavour, filling, design, colours, theme, personalised message and other details.
A custom cake order becomes confirmed only after the design, price and other relevant details have been agreed and the required payment has been made.
Where appropriate, we may request a deposit or full payment before starting work on a custom cake.
7. Design Approval & Personalisation
Customers are responsible for checking the spelling, names, dates, wording and other personalised details they provide.
Once a custom design or wording has been approved, changes may not always be possible.
We will make reasonable efforts to create a cake that reflects the agreed design. Because our cakes are handmade, the final result may have small differences from digital designs, reference photographs or inspiration images.
We will not reproduce another cake designer's work exactly, but may use customer-provided images as inspiration for an original design.
8. Delivery
We offer local delivery within our designated delivery areas.
Delivery availability depends on your location. Please include your delivery area or postcode in your enquiry so that we can confirm whether delivery is available to you.
An additional delivery fee applies to local deliveries. The delivery charge will be confirmed before your order is accepted.
All delivery dates and times are arranged individually and agreed with the customer in advance.
We recommend placing orders a few days in advance. Orders for the following day may be considered depending on availability and must be agreed with us before confirmation.
Customers should ensure that someone is available to receive the order at the agreed delivery time.
If a delivery cannot be completed because nobody is available to receive the order or the delivery information provided is incorrect, we will contact you to discuss the available options. Additional delivery charges may apply for a further delivery attempt, where agreed and permitted by law.
9. Collection
Collection is available by prior arrangement only.
Customers must contact us to agree on a suitable collection date and time.
Please do not arrive for collection without receiving confirmation from us.
Customers are responsible for transporting collected cakes and other products safely once the order has been handed over.
10. Large & Corporate Orders
We welcome enquiries for larger orders, including corporate events, celebrations and larger quantities of macarons and sweet treats.
For large or corporate orders, pricing, delivery, collection arrangements and preparation times may be agreed separately depending on the quantity and requirements of the order.
Please contact us in advance to discuss your requirements.
11. Allergens
Our kitchen handles a range of regulated allergens.
Because multiple allergens are used and handled in our kitchen, there is a risk of unintended allergen cross-contact.
Please read our Allergen Information before ordering.
If you have a food allergy or intolerance, you must contact us before placing your order so that we can provide the most up-to-date information for the specific product.
We do not currently operate as a specialist vegan, gluten-free, sugar-free or free-from bakery.
12. Cancellation & Changes
Cancellation and change options depend on the type of order and how far in advance the request is made.
Because many of our products are freshly prepared, personalised or made specifically for a particular date, cancellation rights may differ from those applicable to standard non-perishable goods.
Please see our Refund & Cancellation Policy for further information.
Nothing in these Terms & Conditions affects your statutory consumer rights.
13. Faulty, Incorrect or Damaged Orders
If your order is incorrect, damaged or does not meet the description agreed with you, please contact us as soon as possible after receiving your order.
Where appropriate, please provide photographs and details of the issue so that we can investigate and determine the appropriate remedy.
Nothing in these Terms & Conditions affects your statutory consumer rights.

16. Website Information
We take reasonable care to ensure that product descriptions, prices and other information on our website are accurate and up to date.
However, handmade products may vary slightly from photographs or descriptions.
We may update website content, products, prices and availability from time to time.

Nothing in these Terms & Conditions affects your statutory consumer rights.
We will not be responsible for problems caused by information supplied incorrectly by the customer, inappropriate storage after delivery or collection, or circumstances outside our reasonable control, except where the law provides otherwise.
18. Events Outside Our Control
Sometimes circumstances outside our reasonable control may affect our ability to fulfil an order, including serious illness, severe weather, transport disruption, power failure, supplier problems or other unforeseen events.
Where this happens, we will contact you as soon as reasonably possible and work with you to find an appropriate solution.
19. Complaints
If you have a problem with your order, please contact us as soon as possible.
We aim to deal with complaints fairly and promptly and will work with you to resolve the issue.
20. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version applicable to your order will be the version in force when your order is accepted, unless a change is required by law.
21. Governing Law
These Terms & Conditions are governed by the laws applicable in the United Kingdom.
Nothing in these Terms & Conditions affects any mandatory consumer rights that apply to you.
